OFFICIAL CONTEST RULES & REGULATIONS
Scotia Funds Your Future (the “Contest”) Official Rules & Regulations (the “Rules”)
By entering this Contest, you agree to abide by these Rules and the decisions of The Bank of Nova Scotia (“Scotiabank” or the “Sponsor”), which are final and binding. This Contest is administered on behalf of Sponsor by ARM Marketing Inc. (the “Administrator”).
1. WHO CAN ENTER
This Contest is open to all students who at the time of entry:
- Are enrolled and in good standing in a Canadian post-secondary institution or will be enrolled by January 31st, 2025;
- Are residing in Canada or will be as of January 31st, 2025;
- Are seventeen (17) years of age or older (or, if under the age of majority in their jurisdiction of residence, have received the permission of a parent or legal guardian who has agreed to be legally bound by these Rules, to enter the Contest and potentially become a winner of a Prize);
- Are not employees of Scotiabank and its affiliates and its and their advertising and promotional agencies as well as the immediate family of such employees and individuals living in the same household with such employees. “Immediate family” is defined as parents, siblings, children or spouse; and
- Are not previous winners of the Scotia Funds Your Future Contest.
Potential winners may be required to provide the Sponsor with proof that the potential winner meets all eligibility requirements, including proof of enrollment in a post-secondary institution, residency status and any other documents required by Sponsor.
2. CONTEST PERIOD
The Contest runs from August 1st, 2024 at 12:00:01 am (ET) to January 31st, 2025 at 11:59:59 pm (ET) (the “Contest Period”).
3. HOW TO ENTER
NO PURCHASE OR ACCOUNT OPENING NECESSARY TO ENTER. VOID WHERE PROHIBITED.
There are two (2) ways to enter the Contest (each an “Entry”) as set out below. Regardless of the method of entry, each eligible entrant can only obtain up to three (3) Entries.
1) Account Opening Method of Entry
Step 1 – Open New Scotiabank Eligible Accounts: New and existing customers* who successfully open any of the following eligible accounts (each an "Account") during the Contest Period can earn one (1) Entry into the Contest per Account Type as follows:
- Account Type 1: Student Banking Advantage Plan – 1 Entry
- Account Type 2: Student Credit Card† – 1 Entry
- Account Type 3: MomentumPLUS Savings Account – 1 Entry
Limit of one (1) Entry per Account Type opened/held (as applicable) regardless of the number of each Account Type opened, up to a maximum of three (3) Entries total. To be eligible, existing and new Account(s) must be open and remain in good standing (not be in default) during the Contest Period and up until the time of winner selection.
* If you are an existing customer who already has one or more of the above listed Accounts at the time of entry, provided you have registered your Account(s) as set out in Step 2 below, you will receive one (1) Entry per Account Type registered that is in good standing and that you already hold at time of entry, regardless of the number of each subsequent Account Type opened, up to a maximum total of three (3) Entries. You will need to complete Step 2 and register your Account(s) to be entered for your chance to win.
† Subject to approval. Entrants under the age of majority are not eligible for credit card accounts. See Section 2 for alternate method of obtaining Entries.
Step 2 – Register Your Account(s): During the Contest Period visit https://arm1.scotiabank.com to register your existing or new Accounts by completing all registration fields (First Name, Last Name, Email Address, Phone Number, Date of Birth, Domestic or International Student Status) and agree to these Rules. If you have registered an Account and later open a new Account during the Contest Period, you will need to register your new Account in order to earn an additional entry.
2) No Purchase or Account Opening Method of Entry:
To enter without opening an eligible account as outlined in Section 1 above, during the Contest Period visit https://arm1.scotiabank.com to enter the Contest by completing all registration fields (First Name, Last Name, Email Address, Phone Number, Domestic or International Student) and agree to these Rules. All entrants under this method of entry will receive three (3) Entries into the Contest.
All Entries become the property of Scotiabank and none will be acknowledged or returned. No responsibility is assumed by Scotiabank for any lost, late, damaged, destroyed, misidentified, illegible or misdirected Entries or for any other such problems occurring in connection with participation in this Contest. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of computer programs and/or other automated devices to enter the Contest is prohibited. Any costs or expenses incurred by entrants in participating in the Contest including data rates if entrant enters the Contest via a mobile device are the responsibility of entrants. Normal internet access and device usage charges imposed by your online service provider will apply.
4. PRIZES
There are a total of two (2) prizes available to be awarded (each a “Prize”). Each Prize is valued at $30,000 CAD and consists of:
- $10,000 deposited into a Scotiabank Student Banking Advantage Plan (SBAP) in good standing (i.e., not in default or delinquency status),
- a 1-year non-redeemable GIC for $10,000 opened in winner’s name, and
- a 2-year non-redeemable GIC for $10,000 opened in winner’s name.
Total value of all Prizes to be awarded is $60,000 CAD.
One (1) Prize will be awarded to a Canadian Citizen or Permanent Resident, and one (1) Prize will be awarded to an International Student. Except at the discretion of Sponsor, Prizes are non-transferable and must be accepted as awarded; no cash substitutes. Sponsor reserves the right to substitute the Prize in whole or in part if all or any of the components of the Prize are unavailable with another prize of equal or greater approximate value. In the event that the winner is unable to redeem any or all of the Prize, due to reasons beyond the control of the Sponsor, its employees, representatives, agents and all parties associated with this Contest, no compensation or substitution prize will be provided. Any costs or expenses incurred by winners in claiming or using their Prizes will be the responsibility of the winners.
5. PRIZE DRAW
A random draw will be conducted on or about February 28, 2025 at or about 12:00:01 pm (ET) from all eligible Entries received during the Contest Period at the offices of Administrator located at 160 Tycos Dr, Suite 120, Toronto, Ontario, M6B 1W8. There will be one (1) Entry randomly chosen from amongst all eligible Canadian Citizen/Permanent Resident Entries received to be eligible to win one (1) Prize, and one (1) Entry randomly chosen from amongst all eligible International Student Entries received to be eligible to win one (1) Prize. The odds of an Entry being drawn in each Prize draw will depend on the total number of eligible Canadian Citizen/Permanent Resident and International Student Entries received during the Contest Period. Limit of one (1) Prize per entrant.
6. SELECTION OF WINNERS
Selected entrants will be notified starting March 3, 2025 and no later than March 31, 2025 by telephone or email using the phone number or email address associated with the entrant and contacted by the Administrator and given instructions on how to claim the Prize.
In order to be declared the Prize winner, in addition to complying with the other terms and conditions of these Rules, the selected entrant must:
- be enrolled and in good standing in a Canadian post-secondary institution at the time of Prize award;
- be residing in Canada at the time of Prize award;
- respond to the notification from Sponsor within forty-eight (48) hours and provide any additional information requested by Sponsor to confirm eligibility and to arrange the award of the Prize;
- correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by mail, email or phone, as Sponsor determines;
- arrange an in-person appointment at a Scotiabank branch at a mutually agreeable time between March 3 and April 30 2025, with a representative from Scotiabank to deliver the Prize;
- have or open a Non-Registered Savings investment plan (or if under the age of majority, a BNS Dealer investment plan), and have an advice conversation to build a financial plan with a Scotiabank advisor *;
- sign a release form (or in the case of a minor, his/her parent or legal guardian must sign a release form) confirming acceptance of the Prize as awarded and releasing Sponsor and its affiliates and the Administrator from any liability relating to the Prize and return it to Sponsor within seven (7) days from the date of receipt (in the case of a winner who is a minor in their jurisdiction of residence, their parent/legal guardian must sign this release form); and
- claim the prize at the mutually agreeable time determined in (v), The prize will be awarded within thirty (30) days.
By accepting the Prize, the winner (or in the case of a minor, his/her parent or legal guardian) consents to the use by Sponsor of his/her name, address (city and province), photo, image, likeness, biographical information, voice and/or any statements made by the winner regarding the Contest or Sponsor for promotional, advertising, marketing, publicity and commercial purposes in any and all media now or hereafter devised, including but not limited to, any online announcements, worldwide in perpetuity, without additional compensation, notification, or permission, except where prohibited by law.
Should a selected entrant fail to meet any of these Rules in Sponsor’s sole discretion, or a selected entrant cannot be reached or a prize notification is returned as undeliverable, entrant will be disqualified. A new random draw will be conducted from amongst all remaining eligible Entries in accordance with these Rules in order to select another potential Prize winner, who will be subject to the same conditions and could be disqualified in the same manner.
7. GENERAL RULES
By entering this Contest, entrants (or in the case of a minor, his/her parent or legal guardian) accept and agree to be bound by these Rules, including all eligibility requirements and the decisions of the Sponsor and the independent judging organization, if any, which are final and binding without right of appeal on all matters relating to this Contest. Sponsor reserves the right to disqualify all entrants who fail to comply with these Rules or who make any misrepresentation relating to the Contest, drawing and redemption of any Prize.
If a dispute arises regarding who submitted an Entry, the Entry will be deemed to be submitted by the authorized account holder of the email address associated with the Entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
By participating, entrants (or in the case of a minor, their parent or legal guardian) release and hold harmless Sponsor and its affiliates, and its and their directors, officers, employees, advertising and promotional agencies affiliated with this Contest, the Administrator, participating establishments and any independent contest judges appointed by Sponsor from any claims, actions, injury, loss, or damage of any kind, including, but not limited to, illness, personal injury or death, resulting, directly or indirectly, in whole or in part, from participating in this Contest or from the acceptance, possession, or use or misuse of the Prize or any portion thereof (including any travel/activity related thereto). This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income or profit; loss of damage to property; and claims of third parties.
The Sponsor shall not be responsible for any failure of email during the Contest or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email, on-line, or Internet entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible for technical problems, traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person’s computer or property related to or resulting from playing or downloading any material in the promotion. The Sponsor reserves the right, at its sole discretion, to cancel, suspend, extend or modify this Contest without notice, obligation or liability if in the Sponsors’ opinion there is any suspected or actual evidence of tampering with any portion of the Contest, or if virus, bugs, non-authorized human intervention, force majeure or other causes corrupt or impair the administration, security, fairness, or integrity and proper play of the Contest, or for any other reason in Sponsor’s sole discretion. In such case, Sponsor may select the winner(s) from all eligible Entries received prior to and/or after (if appropriate) the action taken by Sponsor. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest may be a violation of criminal and civil laws, and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way, or otherwise not in compliance with these Rules.
The Sponsor shall not be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, the Prize awarded in this Contest or the events forming part of this Contest, including but not limited to typographical or other errors in the offer or administration of this Contest, these Rules, the selection and announcement of winners or the distribution of the Prize. The Sponsor and its affiliates, and its and their officers, directors, partners, partnerships, principals, representatives, agents, licensees, successors and assigns (i) make no warranty, guaranty or representation of any kind concerning the Prize, (ii) disclaim any implied warranty or condition, and (iii) are not liable for injury, loss, or damage of any kind resulting from the acceptance, use or misuse of the Prize, travel related thereto or otherwise from participation in this Contest.
In the event of any discrepancy or inconsistency between the terms of these Rules and the terms or statements contained in any short-form Contest rules, advertising materials and/or the French version of these Official Rules, the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by applicable law.
This Contest is subject to all applicable federal, provincial and municipal laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.
8. PRIVACY
The Sponsor is committed to respecting the privacy rights of entrants. Any personal information collected will be handled in strict accordance with the Scotiabank Privacy Agreement found at https://www.scotiabank.com/ca/en/about/contact-us/privacy/privacy-agreement.html and all applicable privacy legislation. The Sponsor will not sell any personal information collected for this Contest to any third parties.
Except as otherwise set forth herein with respect to the Prize winner, any personal information collected for this Contest shall be collected, used and disclosed by the Sponsor solely for the purpose of managing and administering this Contest. By entering this Contest, the entrant hereby consents to the Sponsor's collection, use and disclosure of the entrant's personal information in order to manage and administer this Contest.
9. WINNER NAMES
To obtain the name of the prize winners, available after April 19th, 2025, mail a self-addressed stamped envelope by April 30th, 2025 to: Arm Marketing Inc, 160 Tycos Dr, Suite 120, Toronto, Ontario, M6B 1W8.
SHORT FORM RULES
NO PURCHASE OR ACCOUNT OPENING NECESSARY. Contest runs from August 1st, 2024 at 12:00:01 am (ET) to January 31st, 2025 at 11:59:59 pm (ET). Open to Canadian/Permanent Resident students and International Students 17+ who as of January 31st, 2025 are resident in Canada and enrolled in a post-secondary institution in good standing. Two (2) winners will each receive 1 prize valued at CAD$30,000 consisting of (i) $10,000, (ii) a 1-year non-redeemable GIC for $10,000, and (iii) a 2-year non-redeemable GIC for $10,000. Total value of all Prizes to be awarded is CAD$60,000. One prize will be awarded to a Canadian Citizen/Permanent Resident, and one prize will be awarded to an International Student. Odds of winning depend on total number of eligible entries received from each category of entrant. Skill-testing question required. Some conditions apply.
